Terms of Service
Effective September 16, 2026
Thank you for using Curve Memory. We built it to help you learn things and keep them. Because we don't know every one of our users personally, we have to put in place some Terms of Service to help keep the ship afloat.
When we say "Curve", "we", "our", or "us", we mean Sane Projects, LLC, a Delaware limited liability company. When we say "Services", we mean curvememory.com, the Curve web app, the Curve iOS app, and the Curve MCP server. When we say "you" or "your", we mean the person who holds a Curve account.
By using the Services you agree to these Terms and to our Privacy Policy. When you use the Services, now or in the future, you are agreeing to the latest Terms. There may be times where we do not exercise or enforce a right or provision of the Terms; that does not mean we are waiving that right or provision. These Terms contain a limitation of our liability.
Who can use Curve
- You must be at least 13 years old to use Curve. If you are under 18, or under the age of majority where you live, you confirm that a parent or guardian has read these Terms and agrees to them for you.
- Accounts must be registered by a person. Accounts registered by bots or other automated methods are not permitted. An AI agent may act through your account over MCP, as described under "Agents, MCP access and your own API keys", but the account itself belongs to you.
- Use one account per person, and provide accurate account information.
Your account
- You are responsible for maintaining the security of your account and password. Curve cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- You are responsible for all content posted to and activity that occurs under your account, including content posted by and activity of any agent you have authorised.
- You may not use the Services for any purpose listed under "Use restrictions" below.
The service
Curve turns topics into AI-generated explainers and flashcards, which you study with spaced repetition. You can create decks yourself or through an AI agent, share decks by link, choose to make them public, and study decks that Curve or other users have published.
Generated content can be wrong. Explainers and cards are produced by AI models and may contain errors, omissions, or outdated information. Verify anything important before relying on it. Generated content is not medical, legal, financial, or other professional advice.
We design the Services with care, based on our own experience and the experiences of people who share their time and feedback. However, there is no such thing as a service that pleases everybody. We make no guarantees that the Services will meet your specific requirements or expectations. As with any software, the Services inevitably have some bugs. We track the bugs reported to us and work through priority ones, especially any related to security or privacy. Not all reported bugs will get fixed and we don't guarantee completely error-free Services.
Sometimes it becomes technically impossible to continue a feature, or we redesign a part of the Services because we think it could be better. We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of the Services with or without notice.
Your content
- All content posted to the Services must comply with U.S. copyright law. We explain how to file a copyright infringement claim below.
- You give us a limited licence to use the content you post in order to provide the Services to you, but we claim no ownership rights over those materials. Everything you create or upload remains yours. Specifically, you grant Curve a worldwide, non-exclusive, royalty-free licence to host, store, process, modify and reformat, and display your content in order to operate the Services, to sublicense those rights to the processors who run the Services for us, and, when you share a deck by link or make it public, to distribute it to the people you share it with or to the public.
- As between you and Curve, content generated in your decks is yours. We do not promise that generated content is protectable by copyright, and similar content may be generated for other users who ask about the same topic.
- You are responsible for having the rights you need for anything you upload or point Curve at, including images you ask Curve to fetch from a URL.
- If you stop sharing or unpublish a deck, we stop displaying it to others. Copies that others have already made, and content they have already seen, may remain outside Curve.
- We do not pre-screen content, but we reserve the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the Services.
Curve's content
- Curve or its licensors own all right, title, and interest in and to the Services, including all intellectual property rights therein, and you obtain no ownership rights in the Services as a result of your use. This does not affect your ownership of your own content. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from Curve. You must request permission to use Curve's logos for promotional purposes.
- Decks that Curve publishes in its own catalog are Curve's content. You may study them and share links to them, but you may not resell or redistribute them.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission of Curve. Using the MCP server and API as documented, and exporting or sharing your own content, is of course fine.
Use restrictions
When you use the Services, you acknowledge that you may not:
- Post or generate content that is illegal, that infringes anyone else's rights, or that harasses, threatens, or intimidates others.
- Collect or extract information or user data from accounts which do not belong to you.
- Circumvent, disable, or otherwise interfere with security-related features of the Services, including usage allowances and content safeguards.
- Access the Services by automated means other than the documented MCP server and API.
- Trick, defraud, or mislead us or other users, including by making false reports or impersonating another user.
- Upload or transmit (or attempt to upload or transmit) viruses or any type of malware, or information collection mechanisms such as tracking pixels or web bugs.
- Interfere with, disrupt, or create an undue burden on the Services or the networks connected to them.
- Harass, annoy, intimidate, or threaten any of the people providing the Services to you.
- Use the Services in a manner inconsistent with any applicable laws or regulations.
Accounts found to be in violation of any of the above are subject to suspension or termination without prior notice.
How we moderate. We do not pre-screen content. Decks you make public are checked against a wordlist and may be held back from Explore for review by a Curve admin before they are listed, and we review content in response to reports. If we remove or hide your content, or suspend your account, for a violation, we will tell you by email what we acted on and why, unless the law prevents us from doing so or the content is plainly illegal.
Violations can be reported by emailing support@curvememory.com with detailed information about the account, the content or behaviour you are reporting, and how you found it, including URLs or screenshots. We will not disclose your identity to anyone associated with the reported account.
Copyright complaints
Under the Digital Millennium Copyright Act (17 U.S.C. § 512), you have the right to notify us if you believe a Curve user has infringed your copyright. To be effective, the notification of claimed infringement must be written and include:
- A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work(s) claimed to have been infringed. If there are multiple, a representative list of those works.
- A way for us to locate the material you believe is infringing, such as a deck URL.
- Your name and contact information so that we can get back to you: an email address is preferred, but a telephone number or mailing address works too.
- A statement that you, in good faith, believe that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
Counter-notifications. If you believe your material has been removed in error, you can file a written counter-notification. Please include:
- Your physical or electronic signature, or the signature of a person authorised to act on your behalf.
- A description of the material that was removed and where it appeared in Curve before removal.
- Your name and contact information.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, the District of Delaware.
- A statement that you will accept service of process from the person who filed the original notice or an agent of that person.

We remove infringing content when properly notified and may terminate the accounts of repeat infringers.
Agents, MCP access and your own API keys
Curve offers an MCP server so that AI agents can create and manage decks on your behalf. Any use of the MCP server or API, including through a third-party agent or client, is bound by these Terms plus the following:
- When you authorise an agent through OAuth, it acts under your account with the scopes you granted. You are responsible for what it does, and you can revoke its access at any time. Agents are bound by these Terms and the use restrictions when acting on your account, and we may revoke an agent's access ourselves if it violates them.
- Subject to "Disclaimers and limitation of liability" below, we are not responsible for damages or losses resulting from your use of the MCP server or API, or from third-party agents and clients that access the Services through them. Those agents and clients are built and operated by others, and we are not accountable for them.
- Abuse or excessively frequent requests via the MCP server or API may result in the temporary or permanent suspension of your account's access. Curve, in its sole discretion, will determine abuse or excessive usage. If we need to suspend your access, we will attempt to warn you first. If your usage could cause or has caused downtime, we may cut off access without prior notice.
You may store your own LLM provider API key with Curve. We store it encrypted and use it only to run your generation requests. Generation run on your own key does not count against Curve's allowances. You are responsible for that key, for your provider's terms, and for any charges it incurs. You can remove the key from Curve at any time, or revoke it with your provider.
Plans and payments
- The free plan is really free: we do not ask you for a credit card, and, just like for people who pay for Curve, we do not sell your data. It includes a monthly allowance of Curve-funded generation queries.
- Pro costs $8 per month or $60 per year and includes a larger monthly allowance. Optional top-ups cost $5 for 250 queries and do not expire. Prices are in US dollars.
- Payments on the web are processed by Stripe. If you upgrade from the free plan to Pro, we charge you immediately and your billing cycle starts on the day of upgrade. Pro renews automatically each month or year until cancelled. You can manage or cancel it at any time through the Stripe customer portal.
- Purchases made through the Apple App Store are billed by Apple under Apple's terms, and are managed, cancelled, and refunded through Apple. Where Apple's terms and these Terms differ on billing or refunds for an App Store purchase, Apple's terms apply.
- All fees are exclusive of taxes, levies, or duties imposed by taxing authorities. Where required, we collect those taxes and remit them to the taxing authority. Otherwise, you are responsible for payment of all taxes, levies, or duties.
- Sometimes we change our prices. If we change the price of a plan you are on, we will give at least 30 days' notice by email before the new price applies to you.
Refunds
- When you cancel Pro, you keep access until the end of the period you have paid for and you will not be charged again. We do not prorate or refund unused time in the last billing cycle.
- Top-ups are non-refundable once purchased.
- If you were charged in error, or charged twice, contact support@curvememory.com and we will refund the mistaken charge.
- If you are a consumer in the EU or UK, you have 14 days after a purchase to change your mind. Because you ask us to start Pro or to make your top-up queries available immediately, if you cancel within those 14 days we refund what you paid less a proportionate amount for the days or queries you have used. After 14 days, the rules above apply. App Store purchases follow Apple's cancellation and refund rules.
Cancellation and termination
- You are solely responsible for cancelling your Pro subscription. Cancel it through the Stripe customer portal (or, for App Store purchases, in your App Store subscriptions). An email asking us to cancel is not automatically considered a cancellation. If you need help, contact support.
- You can delete your account at any time from Settings on the web or in the iOS app. All of your content will be inaccessible from the Services immediately upon deletion. Residual copies in backups and operational logs expire on a rolling basis, as described in the Privacy Policy. We cannot recover your account once it has been deleted, so export anything you want to keep first.
- We may suspend or terminate your account if you violate these Terms or the use restrictions, if we reasonably believe your account poses a risk to Curve, other users, or third parties, if we are required to by law, or, with reasonable notice, if we discontinue the Services. Suspension means you will not be able to access the account or any content in it. When we suspend or terminate your account for a violation, we will tell you the reason by email. Unless your content is illegal or we are legally required to withhold it, you will have 14 days after termination to export your content before your account and its content are deleted.
- Verbal, physical, written, or other abuse (including threats of abuse or retribution) of anyone working on Curve will result in immediate account termination.
Uptime, security and your data
- Your use of the Services is at your sole risk. We provide the Services on an "as is" and "as available" basis. We do not offer a service-level agreement, but we do take uptime seriously.
- We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other Curve users. We will reach out to you before taking any action, except in rare cases where the level of use may negatively impact the performance of the Services for other users.
- We take measures to protect and secure your data through backups and encryption, and we encrypt data in transit. The Privacy Policy describes what we collect and how we handle it.
- When you use the Services, you entrust us with your data. We take that trust to heart. You agree that Curve may process your data as described in our Privacy Policy and for no other purpose. We as humans can access your data for the following reasons:
- To help you with support requests you make. We will ask for express consent before accessing your account.
- On the rare occasions when an error occurs that stops an automated process partway through. We get automated alerts when such errors occur. When we can fix the issue and restart automated processing without looking at any personal data, we do. In rare cases, we have to look at a minimum amount of personal data to fix the issue. In these rare cases, we aim to fix the root cause to prevent the errors from recurring.
- To safeguard Curve. We will look at logs and metadata as part of our work to ensure the security of your data and the Services as a whole. If necessary, we may also access accounts as part of an abuse report investigation.
- To the extent required by applicable law. As a US company with all data infrastructure located in the US, we only preserve or share user data if compelled by a US government authority with a legally binding order, or in limited circumstances in the event of an emergency request.
- We use third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology required to run the Services. The Privacy Policy lists them.
Disclaimers and limitation of liability
We provide the Services "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Explainers and cards are generated by AI and may be wrong; they are not medical, legal, financial, or other professional advice.
If you are not a consumer in the EU or UK: Curve is not liable to you or any third party for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, goodwill, use, or data, arising from (i) the use of or inability to use the Services; (ii) substitute goods or services; (iii) unauthorised access to or alteration of your data; (iv) statements or conduct of any third party or agent on the Services; (v) inaccuracy of content generated by the Services; or (vi) any other matter relating to the Services, under any theory of liability, even if we were advised of the possibility. Our total liability for all other claims is limited to the greater of US$50 and the amount you paid Curve in the 12 months before the event giving rise to the claim. These limits do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot legally be limited.
If you are a consumer in the EU or UK, the previous paragraph does not apply to you and this one does instead. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to provide the Services with reasonable care and skill. We are not responsible for loss that was not foreseeable when you agreed to these Terms, for business losses, or for loss caused by your own breach of these Terms or by events outside our reasonable control. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything the law does not let us limit, and nothing takes away your statutory rights, including your right to digital content and services that match their description and are supplied with reasonable care and skill.
Subject to the exceptions above: choosing to use Curve does mean you are making a bet on us. If the bet does not work out, that's on you, not us. We do our best to be as safe a bet as possible through careful management of the business and investment in security and infrastructure. If you choose to use Curve, thank you for betting on us.
Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from third-party claims, damages, and reasonable legal costs arising from your content, your misuse of the Services, or your violation of these Terms or of others' rights. This does not cover losses caused by our own wrongdoing.
Changes to these Terms
We may update these Terms in the future. Whenever we make a material change, we will refresh the date at the top of this page and email account holders at least 30 days before the change takes effect. If you are a consumer and do not accept a material change, you may cancel before it takes effect, and we will refund pro rata any fees you have prepaid for the period after your cancellation. Minor changes, such as clarifications, take effect when posted. Continuing to use Curve after a change takes effect means you accept it.
Governing law and contact
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Delaware, and you consent to their jurisdiction. If you are a consumer, nothing in this section takes away protections you have under the mandatory laws of the place where you live.
